Buying a property in Dubai that is yet to be built, known as off-plan, seems like a smart move to many. But what if you miss a payment? Many buyers do not realise this can have serious consequences, often involving much more than just a late payment fee.

A Missed Payment Can Prove Costly

If you fail to meet a payment obligation for an off-plan project in Dubai, it can lead to the cancellation of your purchase contract. Under the rules of RERA (Real Estate Regulatory Authority), developers have the right to terminate the contract if payments are not made. This does not happen arbitrarily: the developer must first send an official notice of default and give you a reasonable period to make the payment.

Nevertheless, it is important to know that if this period expires and the payment is still outstanding, the consequences can be significant. Depending on the construction phase of the project, you could lose between 30% and 40% of the property’s value. This is money you have already invested and, in many cases, will not get back.

How to Avoid Payment Problems

It all starts with reading carefully. Review your purchase contract thoroughly, paying particular attention to the payment terms, grace periods (the allowed deferral periods), and the penalties for late payments. Every developer has its own policy. Some offer a few days’ grace, while others initiate the legal process almost immediately.

Also, ensure your payment schedule aligns with your cash flow. Unexpected financial setbacks can otherwise quickly lead to payment arrears with all the attendant consequences. Therefore, it is wise to contact the developer in advance if you have any doubts. Sometimes there is room for negotiation or an adjusted payment plan.

In short, missing an instalment is not just inconvenient; it can also mean the difference between keeping or losing your property in areas like Dubai Marina or Palm Jumeirah. Be prepared and avoid surprises.
